Terms & conditions

These terms and conditions apply to all transactions entered into on this site. Your use of this site indicates an agreement to be bound by these terms and conditions. They do not affect your statutory rights.

1. Accuracy of information

1.1 Whilst we take every care with the information and images on this web site, we cannot be held liable for any errors and omissions. Due to continuous product development, specifications may change at any time, and we may substitute a product for one of a similar or of a better quality.

2. Offer and acceptance

2.1 This site constitutes our invitation to you to do business with us. An order submitted by you is your offer to enter into a contract with us. After receipt of your order we shall send you an e-mail confirming the order you have made and that we have accepted your order, subject to our terms and conditions, payment being received in full and availability of the items ordered. Please note that a legally binding contract between us will only come into effect when our confirmation of acceptance is sent to you.

2.2 We reserve the right to reject or decline your offer in any circumstances, which are not limited to any fraudulent misrepresentation or attempt to obtain any product unlawfully.

3. Prices & Payment

3.1 All prices and charges are charged and payable in UK pounds sterling.

3.2 We must receive payment for the full price for the goods ordered and before any delivery is dispatched.

3.3 We accept payment by Delta, Electron, MasterCard, Solo, Switch/UK Maestro and Visa.

3.4 All Prices Include Vat: Unless Stated otherwise.

4. Delivery

4.1 For Northern Ireland and other islands please call for a quotation. Free deliveries are made in working hours on week days only.

4.2 We will endeavour to deliver the products within 4 to 7 working days from the date of acceptance of an order. However, please allow up to 15 working days for delivery.

4.3 We shall make every effort to deliver goods within the estimated times. However, occasional delays may occur due to unforeseen factors beyond our control and therefore please note delivery times are not guaranteed. Accordingly we shall not be liable for any delay or failure to deliver the products within any estimated timescales.

4.4 Risk of loss of and damage to products passes to you on the date we attempt to deliver the products. We cannot accept any liability for any loss or damage to products, which remain in our custody and care because you were unable to receive them for whatever reason.

4.5 Any delivery charges payable are subject to variation at any time.

4.6 Delivery of the products will be at the address given on your order form.

4.7 For delivery purposes, it is your duty to ensure there is free and unrestricted access to the delivery address. You are required to notify us of any restrictions or access difficulties. Should delivery not be possible due to restricted access or for Health & Safety reasons we shall not be responsible for our inability to deliver.

5. Incorrect Orders, Missing, Damaged or Faulty Products

5.1 Should any product be damaged or prove to be faulty, you must immediately notify us of the problem and follow any instructions given or enclosed with the product.

5.2 If there is an unreasonable delay in notifying us we reserve the right not to accept the return of the product, subject to your statutory rights.

6. Cancellation

6.1 You can cancel your order at any time before your order is dispatched. You may cancel by e-mail and/or by telephoning us on the number stated, subject to your following any instructions given.

6.2 In the event you cancel after the goods are dispatched, you will be liable for a cancellation fee together with any charges incurred, which will include courier and admin costs. You will be required to discharge these costs incurred within 7 days upon your receiving our invoice.

6.3 You will not be able to cancel your order if:

• The products were a special order made to your specification.
• You have opened the product and damaged the box, container or packaging of the product.
• You have used the product or damaged the product.

7. Return of Faulty Products

7.1 You must keep all packaging & boxes. Under the terms of warranty you will be required to re-pack any faulty items in the original packaging for return and provide proof of purchase and delivery.

7.2 If any product delivered is found to be faulty upon delivery, we will arrange to have this product collected free of charge. The product must be packaged in the original packaging and be made available for collection within 24 hours of you notifying us of the fault. If, when the courier arrives to collect the product, it is found not to be available/ready, a charge will be payable by you for the courier to re-collect. Once the product is received by us, we will inspect the product and if necessary arrange to send out a replacement product.

7.3 Please note that if the product is found on inspection not to be faulty on its return to us, we reserve the right to send this product back to you and all delivery charges will be payable by you.

8. Exchange or Returns

8.1 Before any exchange or return can be agreed you will be required to produce proof of purchase.

8.2 You must keep all packaging. You will be required to repack any items in the original packaging for return to us. We cannot accept any products for return that are not in their original packaging.

9. Installation

9.1 If you require installation of a product, installation can be arranged subject to our agreeing to undertake the installation and agreeing a price for installation.

10. Indemnity & Liability

10.1 We will use our reasonable endeavors to verify the accuracy of any information on this site but we make no representations or warranty of any kind, express or implied statutory or otherwise, regarding the contents of this site. Neither do we make any representations or warranty that this site will be available at any time. We will not be responsible or liable to you for any loss of content or material uploaded or transacted through this site and we accept no liability of any kind for any loss or damage from action taken in reliance on material or information contained in this site.

10.2 We will not be liable in contracting (including, without limitation, negligence and/or we will not be liable for any pre-contract statements or other representations or in any other manner for any: (a) economic losses including limitation loss of revenue, profits, contracts, business or anticipated savings; or (b) loss of good will or reputation; or (c) special or indirect losses suffered or incurred by you arising or which may arise as a result of or in connection with your use of this site or for any prospective or actual purchase of any products and services from us.

10.3 We will take all reasonable precautions to keep the details of your credit card and payment secure, but unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

10.4 If we give advice by telephone or otherwise concerning the suitablity or use of any product, we shall not be liable for any representations made or for any losses or damage/injury suffered. You are strongly recommended to make your own enquiries and also seek advice from your own doctor or exercise/fitness expert as tot he suitability of the product.

11. General

11.1 These terms and conditions and all transactions relating to this site are governed by English Law and are subject to the exclusive jurisdiction of the English Courts. We do not accept any amendments to these terms and conditions by you.

11.2 These terms and conditions do not create or confer any benefits enforceable by any person that is not a party within the meaning of the Contract (Rights of Third Parties) Act 1999.
